Final Civil Action – Loan Origination Fraud on Federal Housing Administration Loans (Report Not Available to the Public)

We reviewed alleged violations of U.S. Department of Housing and Urban Development (HUD) Federal Housing Administration (FHA) loan origination requirements by the subject. We concluded that the subject placed fraudulent information and documents in mortgage loan applications for Government-insured home loans. The Department of Justice filed a complaint under the Financial Institutions Reform, Recovery, and Enforcement Act; and in March 2012 reached a settlement with the subject.

The U.S. Department of Housing and Urban Development (HUD), Office of Inspector General (OIG), conducted a review of loans underwritten by Countrywide Home Loans Inc., and its divisions Countrywide Bank FSB and Countrywide Mortgage Ventures, LLC. The objective of the review was to determine whether Countrywide underwrote Federal Housing Administration (FHA) loans in accordance with HUD-FHA regulations. Countrywide is a subsidiary of Bank of America, Charlotte, NC. Bank of America acquired Countrywide on January 11, 2008.

Final Civil Action - Flagstar Bank, FSB, Settled False Claims Act Allegations of Submitting False Certifications to HUD on FHA Loans

The U.S. Department of Housing and Urban Development (HUD), Office of Inspector General (OIG), assisted the U.S. Attorney’s Office, Southern District of New York, in conducting a review of Flagstar Bank, FSB. The objective of the review was to determine whether Flagstar conducted its operations in the underwriting of Federal Housing Administration (FHA) loans in accordance with HUD-FHA regulations. Flagstar Bank, FSB, is a supervised direct endorsement lender headquartered in Troy, MI.

The John C. Cannon Retirement and Assisted Living Residence, Seattle, Washington, Violated Its Regulatory Agreement

At the request of the Region X Multifamily Hub, we audited the John C Cannon Retirement and Assisted Living Residence (project) to determine if the project owner used project funds in accordance with the regulatory agreement. We found that the project owner failed to get HUD approval for leases costing $189,000, used project funds to obtain unneeded equipment costing $10,700, and failed to keep adequate documentation to support expenditures costing $317,000.

Alaska Housing Finance Corporation’s Management and Occupancy Reviews Were Not Always as Comprehensive as Required for a Section 8 Performance-Based Contract Administrator

The U.S. Department of Housing and Urban Development's (HUD) Office of Inspector General audited the Section 8 Performance Based Contract Administration (PBCA) program of the Alaska Housing Finance Corporation (Corporation). We wanted to determine whether the Corporation fulfilled its contractual responsibilities as a performance-based contract administrator (contract administrator) of project-based Section 8 housing assistance payments contracts. The Corporation generally fulfilled its responsibilities as a contract administrator.

Richard A. Hutchens Associates, Management Agent, Buffalo, New York, Used Project Funds for Ineligible and/or Unsupported Cost

We completed an audit of Richard A. Hutchens and Associates (agent) pertaining to its management of the financial operations of Cayuga Village and Touraine Apartments. The objectives of our audit were to determine whether the agent used project funds in accordance with the regulatory agreement and HUD requirements.

HUD Did Not Adquately Monitor Its Performance-Based Contract Adminstrator, New York State Housing Trust Fund Corporation

We completed an audit of the U.S. Department of Housing and Urban Development's (HUD) monitoring of its annual contributions contract with its performance-based contract administrator, the New York State Housing Trust Fund Corporation (contractor). The audit was initiated in accordance with the Office of Inspector General's (OIG) audit plan that includes performing internal audits to evaluate HUD's execution of its fiscal responsibilities.
